These Terms of Service govern your use of MenuRank AI, operated by Simerge LLC.

By using the MenuRank AI app or website, you agree to these Terms and the Privacy Policy.

1. The Service

MenuRank AI analyzes restaurant-menu images and provides AI-generated rankings and estimates based on preferences selected by the user.

AI-generated results may be incomplete, inaccurate, outdated, or unsuitable for your particular circumstances.

We do not guarantee that any menu item, ingredient, drink, price, allergen, nutrition estimate, dietary classification, or recommendation is correct.

2. Food Safety, Allergies, and Health

MenuRank AI does not provide medical, nutritional, dietetic, allergy, or other professional advice.

Restaurant ingredients, recipes, preparation methods, prices, alcohol content, and cross-contact risks can change.

Always confirm ingredients, allergens, alcohol content, preparation methods, and dietary suitability directly with restaurant staff before ordering.

People with serious allergies, medical conditions, or urgent health concerns must not rely on MenuRank AI for health or safety decisions.

The service is not intended for emergencies.

3. Free and Paid Access

Free access is available for up to 15 scans during the first 7 days after the user's first successful scan.

Free access ends when the user reaches 15 scans or when the seven-day period expires, whichever occurs first.

Pro plans include 60 scans per UTC calendar month.

Unused scans do not roll over.

Current prices, billing periods, currency, taxes, and any introductory offer are displayed before purchase and may vary by App Store storefront.

Paid subscriptions automatically renew unless canceled through the user's Apple Account before renewal.

Apple processes payments, subscription management, cancellations, and refund requests under its applicable terms and policies.

4. Your Content and Conduct

You retain ownership of menu photos and other content you submit.

You grant Simerge LLC a limited, non-exclusive permission to process submitted content only as reasonably necessary to provide, secure, maintain, and support the service.

You must have the right to submit the content.

You must not:

• Misuse or interfere with the service.
• Bypass scan limits or access restrictions.
• Use unauthorized automation.
• Attempt unauthorized access.
• Violate another person's rights.
• Use the service unlawfully.

5. Ownership and Third-Party Services

MenuRank AI, its software, branding, designs, and related materials are owned by Simerge LLC.

You receive a limited, personal, revocable, non-exclusive, and non-transferable right to use the service in accordance with these Terms.

The service relies on Apple and other third-party services. The availability and performance of these services may affect certain features or functionality of MenuRank AI. Their use is also subject to their own terms and policies.

Apple's Standard End User License Agreement applies to the iOS application unless another applicable agreement is presented through Apple.

6. Availability and Changes

The service is provided "AS IS" and "AS AVAILABLE."

We do not guarantee uninterrupted availability, error-free operation, or that every defect will be corrected.

To the extent permitted by applicable law, we may update, modify, suspend, discontinue, or change features, usage limits, eligibility requirements, or plans.

Changes affecting active paid subscriptions remain subject to Apple's requirements and applicable law.

7. Disclaimer and Limitation of Liability

To the maximum extent permitted by applicable law, Simerge LLC disclaims all express and implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, and non-infringement.

To the maximum extent permitted by applicable law, Simerge LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits or data; decisions or actions taken in reliance on AI-generated results; or harm resulting from reliance on inaccurate menu, drink, price, ingredient, nutrition, allergy, dietary, or health-related information.

Nothing in these Terms excludes or limits liability or consumer rights that cannot lawfully be excluded or limited.

Some jurisdictions do not permit certain exclusions or limitations, so some provisions may not apply to every user.

8. Suspension and Termination

We may suspend or terminate access where reasonably necessary to address fraud, abuse, security risks, unlawful activity, nonpayment, unauthorized access, or material violations of these Terms.

Provisions that by their nature should survive termination will remain effective after termination.

9. Governing Law and Consumer Rights

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles, except to the extent that mandatory consumer protection laws in your jurisdiction provide otherwise.

Nothing in these Terms limits or excludes mandatory consumer rights that cannot be waived or limited under applicable law.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

10. Changes

We may update these Terms when the service, business practices, or legal obligations change.

Continued use of the service after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
